Tai Chi Terms of Use

For use with the Tai Chi mobile application, website, guided movement plans, and related services.

1. Acceptance of Terms

These Terms of Use govern your access to and use of the Tai Chi mobile application, website, videos, audio guidance, movement plans, progress tools, and related services (collectively, the “Services”). By downloading, accessing, creating an account for, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old to use the Services. Tai Chi is designed to support general wellness, gentle movement, balance confidence, flexibility, and healthy aging for adults seeking guided at-home practice.

3. Important Medical Disclaimer

Tai Chi provides general fitness, mobility, wellness, and educational content only. The Services are not medical care and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Tai Chi does not provide medical services, physical therapy, rehabilitation, nursing care, or emergency services, and use of the Services does not create a doctor-patient, therapist-patient, or other clinical relationship. Consult a physician or other qualified healthcare professional before beginning any exercise or movement program, especially if you have arthritis, osteoporosis, dizziness, balance disorders, chronic pain, heart disease, a recent injury, a recent surgery, or any condition that affects mobility or exercise tolerance. Stop immediately and seek medical attention if you experience chest pain, fainting, severe dizziness, sudden weakness, trouble breathing, or significant pain during activity.

4. Safety and Assumption of Risk

Physical activity involves inherent risks, including falls, strains, sprains, aggravation of existing conditions, and other injuries. You voluntarily assume these risks when using the Services. You are responsible for choosing a safe environment, using stable support when needed, wearing appropriate footwear, and exercising only within your capabilities. Tai Chi may provide progression levels, modifications, support options, safety reminders, and rest guidance. These features are helpful but do not eliminate risk.

5. Accounts and Security

Certain features may require an account. You agree to provide accurate and current information and to keep your login credentials secure. You are responsible for activity that occurs under your account. Notify us promptly at alexlibyebye@gmail.com if you suspect unauthorized access or a security incident.

6. License and Permitted Use

Subject to these Terms, Tai Chi grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use only. You may not copy, reproduce, resell, distribute, publicly display, or otherwise exploit the Services except as expressly allowed by law or by written permission. You may not reverse engineer, decompile, scrape, automate access to, or interfere with the operation or security of the Services.

7. Intellectual Property

All videos, audio files, text, movement progressions, exercise sequences, graphics, software, trademarks, logos, and related content are owned by Tai Chi or its licensors and are protected by intellectual property laws. No ownership rights are transferred to you. Any feedback or suggestions you submit may be used without restriction or compensation.

8. User Data and Progress Information

The Services may allow you to input or generate data such as age range, movement preferences, session history, completed classes, and progress indicators. Any recommendations or progress summaries are informational only and are not medical advice. Tai Chi does not guarantee any specific outcome, including pain relief, improved balance, strength gains, reduced fall risk, or increased mobility.

9. Paid Features and Subscriptions

Some features of Tai Chi may require payment or a recurring subscription. Paid access is governed by these Terms together with the Tai Chi Payment & Subscription Terms. If you purchase through Apple’s App Store, billing, renewals, and cancellation are handled through your Apple ID and Apple account settings.

10. Third-Party Services

The Services may rely on or link to third-party providers such as cloud hosting, customer support tools, analytics services, payment processors, or platform providers. Tai Chi is not responsible for third-party content, availability, or practices.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. This includes warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Services will be uninterrupted, error-free, or suitable for your individual health or fitness needs.

12. Limitation of Liability

To the maximum extent permitted by law, Tai Chi and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, profits, goodwill, or business interruption arising out of or related to your use of the Services. To the maximum extent permitted by law, Tai Chi’s total liability for any claim arising out of or relating to the Services will not exceed the greater of (a) the amount you paid during the 12 months before the claim arose or (b) US$50.

13. Indemnification

You agree to defend, indemnify, and hold harmless Tai Chi and its affiliates, officers, employees, contractors, and licensors from claims, damages, losses, and expenses arising from your misuse of the Services, your violation of these Terms, or your violation of applicable law or third-party rights.

14. Termination

Tai Chi may suspend or terminate your access to the Services if you violate these Terms, create legal or security risk, or if some or all of the Services are discontinued. You may stop using the Services at any time. Termination does not affect payment obligations already incurred.

15. Changes to the Services or Terms

We may update the Services and these Terms from time to time. If changes are material, we may provide notice through the app, website, email, or other reasonable means. Your continued use after the effective date of revised Terms constitutes acceptance.

16. Governing Law and Disputes

These Terms are governed by applicable law to the maximum extent permitted by the laws that apply to your use of the Services. Any dispute arising out of or relating to these Terms or the Services will be handled through the procedures and venues available under applicable law.
